RumX Terms & Conditions: Rules for Using Our App

1. Provider and Scope

These Terms & Conditions ("Terms") govern the use of the RumX website (rumx.com), the RumX mobile application, and the RumX community forum (community.rumx.com) — together the "Service". The Service is provided by:

By creating an account or using the Service you accept these Terms. Mandatory statutory rights that you have as a consumer — in particular under the law of your country of residence within the EU — remain unaffected by these Terms and apply with priority where these Terms deviate from them.

Marketplace note: RumX is a rum database, community and marketplace platform. RumX does not sell alcoholic beverages itself. Purchases are concluded with licensed partner shops; for purchases, our Terms of Sale additionally apply.

2. Minimum Age

The Service relates to alcoholic beverages and may only be used by persons who are 18 years of age or older. By using the Service, you confirm that you are at least 18 years old. We may delete accounts of users who do not meet this requirement.

3. Your Account

You must provide accurate and current information when creating an account and keep it up to date. You are responsible for keeping your password confidential and for activity under your account; notify us immediately at info@rumx.com if you become aware of any unauthorized use.

You may not use a username that violates the rights of others, impersonates another person, or is offensive, vulgar or obscene.

4. User Content

4.1 Your Content and License to Us

The Service allows you to post content such as ratings, tasting notes, reviews, photos, comments and forum posts ("Content"). You retain all rights to your Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt (e.g. for display formats), publicly display and distribute your Content on and through the Service, including making it available to other users. This license exists solely for operating, promoting and improving the Service and ends when you delete your Content or your account, except (i) for Content that has been shared with or re-used by other users within the Service, (ii) where we are legally required to retain it, and (iii) for backup copies deleted in the ordinary course.

You warrant that you own your Content or have the necessary rights to it, and that it does not violate the rights of third parties.

4.2 Content Rules (Moderation Policy)

You may not post Content that:

  • is illegal or promotes illegal activity;
  • is defamatory, discriminatory, harassing or hateful;
  • is spam, machine-generated, or unauthorized advertising;
  • contains malware or other harmful code;
  • infringes intellectual property or privacy rights of others;
  • impersonates any person or entity;
  • contains deliberately false information (e.g. manipulated ratings or reviews).

4.3 How We Moderate (Transparency under Art. 14 DSA)

We use a combination of automated filtering (to detect potentially objectionable content before it becomes visible) and human review. All users can report content via the "Report" feature available on all user-generated content or by email to info@rumx.com. You can also block other users. We aim to review reports within 24 hours.

If Content violates these rules or applicable law, we may remove or restrict its visibility, and in case of repeated or serious violations suspend or terminate the account. When we restrict or remove Content or accounts, we will inform the affected user of the decision and the reasons for it, unless we are legally prevented from doing so. You can contest a moderation decision by replying to the notification or contacting info@rumx.com; we will re-review the decision.

4.4 Reporting Illegal Content (Notice and Action, Art. 16 DSA)

You can notify us of content you consider illegal at any time via the in-app "Report" feature or by email to info@rumx.com. To help us assess your notice, please include: (i) an explanation of why you consider the content illegal, (ii) the exact location (URL or screenshot), (iii) your name and email address (unless the notice concerns certain serious offences where anonymity is permitted), and (iv) a statement that your notice is accurate and complete. We process notices diligently and without undue delay and inform you of our decision.

4.5 Intellectual Property Complaints

If you believe content on the Service infringes your copyright, trademark or other intellectual property rights, send a notice to info@rumx.com including: identification of the protected work, the location of the allegedly infringing content (URL), your contact details, and a statement that you believe in good faith that the use is unauthorized. We will review the notice and remove or disable access to infringing content where appropriate. Knowingly submitting false infringement claims may make you liable for resulting damages.

4.6 Content Backups

We perform regular backups but cannot guarantee that Content will never be lost or corrupted. Please keep your own copy of Content that is important to you.

5. Intellectual Property of RumX

The Service and its original content (excluding user Content), features and functionality — including the rum database structure, editorial content, design and software — are and remain the property of RumX and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.

6. Feedback

If you send us feedback, suggestions or ideas regarding the Service, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use and exploit this feedback for improving and operating the Service. Your moral rights and any mandatory statutory rights remain unaffected.

7. Third-Party Links and Services

The Service contains links to third-party websites (e.g. partner shops) and embeds third-party services. We are not responsible for the content or privacy practices of third-party websites. The terms and privacy policies of those third parties apply to their services.

8. Availability; Changes to the Service

We provide the free parts of the Service with reasonable care but do not guarantee uninterrupted availability. We may further develop, modify or discontinue individual free features of the Service where this is reasonable for users, taking into account our legitimate interests (e.g. technical progress, security, economic operation). For paid subscriptions, section 13 and mandatory consumer law apply.

9. Termination

You may stop using the Service and delete your account at any time in the app's profile settings.

We may suspend or terminate your account with reasonable prior notice if a good cause exists, in particular if you materially or repeatedly violate these Terms (e.g. the content rules in section 4), if your account is used fraudulently, or if we are required to do so by law. In cases of serious violations that make continued use unacceptable for us or other users, we may suspend or terminate the account without prior notice. Section 4.3 (statement of reasons, re-review) applies to account suspensions.

10. Liability

We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and to the extent of any guarantee we have expressly assumed.

In cases of simple negligence, we are liable only for the breach of essential contractual obligations — obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely (so-called cardinal obligations) — and in such cases only up to the amount of the foreseeable damage typical for this type of contract.

Any further liability is excluded. The above limitations also apply in favour of our legal representatives and agents. Your mandatory statutory rights, including consumer rights and warranty rights, remain unaffected.

11. Changes to These Terms

We may amend these Terms with effect for the future where this is necessary for valid reasons — e.g. changes in the law or case law, new features, security requirements, or changes to the Service — and the amendment is reasonable for you. We will notify you of material changes at least 30 days before they take effect (e.g. by email or in-app notice). If you do not object before the changes take effect, the amended Terms apply; we will specifically point out your right to object and the consequences in the notification. If you object, both you and we may terminate the user relationship; your statutory termination rights remain unaffected. Changes do not apply retroactively to orders already placed.

12. Governing Law and Disputes

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with habitual residence in the EU, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence (Art. 6 Rome I Regulation).

If you have any concern or dispute, please contact us first at info@rumx.com — most issues can be resolved directly. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

13. RumX Pro Subscription Terms

These supplemental terms govern the optional RumX Pro in-app subscription.

13.1 Features

  • Market Price Estimates: insights into the latest market prices of rums.
  • Personalized Daily Deals: personalized rum deals based on your preferences and wishlist.
  • Custom Lists: organize your rums in personalized lists, e.g. tasting line-ups.
  • Export Data: export your collection and tasting data in CSV format.
  • Premium Profile: a gold-plated user profile.
  • Loyalty Points: monthly points redeemable for rewards.

13.2 Contract, Price and Renewal

RumX Pro is purchased as an in-app subscription via the Apple App Store or Google Play Store. The price, billing period (e.g. monthly or yearly) and renewal date are displayed in the store before you subscribe. The subscription renews automatically for the selected billing period until you cancel it.

13.3 Cancellation

You can cancel at any time with effect from the end of the current billing period in your device's subscription settings (Apple: Settings → Apple Account → Subscriptions; Google: Play Store → Payments & subscriptions). To avoid renewal, cancel before the renewal date — note that the store may require cancellation up to 24 hours (Apple) before renewal. Deleting the app does not cancel the subscription.

13.4 Withdrawal and Refunds

Statutory withdrawal rights for digital content/services purchased via the app stores are handled by Apple or Google as the merchant of record; refund requests must be directed to the respective store. Your statutory rights remain unaffected.

14. Final Provisions

If any provision of these Terms is or becomes invalid, the remaining provisions remain in effect. These Terms are available in English, German and French; for consumers, the language version of the respective country site applies. The German version applies to users in Germany and the French version to users in France.
